That's wonderful. I hate how Gates gets stick as some kind of...techno overlord who sits on an obsidian throne of iron, directing a horde of demon minions against everything that's right and just in the world. He's an incredible guy for what he does with his money and deserves huge respect, which I don't think he gets.

John Terry gagging order lifted by High Court

 

An injunction stopping the media from reporting allegations about England football captain John Terry's private life has been lifted by the High Court.

 

Mr Justice Tugendhat removed the order, taken out by married Terry, which banned reports about his alleged affair with a Chelsea team-mate's ex-partner.

 

An interim order had been granted at a private hearing in London last Friday.

 

It had banned publication of details of the alleged relationship and barred the use of photographs relating to it.

 

However, the judge said the information was in "wide circulation amongst those involved in the sport in question, including agents and others, and not just amongst those directly engaged in the sport".

 

Justice Tugendhat said he thought Terry's real concern was the effect on his sponsorship contracts, in which case, payment of damages would be an adequate remedy if he succeeded at trial.

 

The judge said: "Freedom to live as one chooses is one of the most valuable freedoms, but so is the freedom to criticise".

 

Lawyers for Terry had obtained the injunction a week ago, after learning that the News of the World planned to write about him.

 

BBC media correspondent Torin Douglas said the existence of these so-called super-injunctions had become more widely known recently.

 

He said: "Lawyers for the oil trading firm Trafigura stopped a parliamentary question being reported by the Guardian, until its identity became widely known via the Twitter social network.

 

"This ruling recognises the right of media to report."

 

News of the World legal manager Tom Crone welcomed the decision as "a long overdue breath of fresh air and common sense".

 

"Over recent years, there has been more prior restraint on freedom of speech in Britain than in any other democratic country in the world," he said.

 

"Gagging orders like the one sought by John Terry have been granted to numerous other Premier League footballers and assorted celebrities."

 

He said he hoped the ruling would lead to "a fundamental reassessment of our draconian privacy laws".

 

A Chelsea spokesman said: "This is a personal matter for John Terry. The club will give John and his family all the support they need in dealing with it."

 

Terry, 29, married childhood sweetheart Toni Poole in 2007 and is the father of twins. He is expected to captain England at this summer's World Cup finals in South Africa.

Huzzah! Death to anti democratic super injunctions!

 

I agree with what you are saying, although i don see it as anti democratic. Me not knowing about john terry shagging who ever is hadly going to be the downfall of democracy.

But i hope death comes soon for papers printing this shit. If hes been shaging around thats his buisness. I dont need to know about it.

I'm not bothered about Terry myself either, but generally these super injunctions are the most anti democratic legal constraints imaginable. They go way beyond any reasonable grounds for the protection of sensitive information are are being used wholesale to gag and impede the free press. We don't even know how many of them exist, or what they could be covering up. It's completely batshit.

Yeah this always irritates me.

 

I know Microsoft is now a huge multi-national corporation that are involved in a lot of practices that make you go, "urgh...".

 

But the man himself, is a fecking legend.

 

IQ of 170, changed the world and currently runs an charity which delivers over 20 billion dollars in aid.

 

Pretty cool guy.

"The problem now is the stakes are so much higher because if a juvenile sends a picture of themselves to someone else, well, that can be disseminated now to the entire world within minutes."

 

And that's distribution of child pornography, Gensel said.

 

Last week, two middle school students in Valparaiso, Ind., were caught sending nude pictures of themselves to each other on their cell phones. The students were caught when the 13-year-old girl's cell phone rang in class, and her teacher confiscated it, according to a police report. The girl cried that she would get in trouble because a 12-year-old boy sent her a "dirty picture."

 

The boy sent the girl a picture of his genitals and requested that she do the same, the report said. The girl then texted him a picture of her naked, police said.

 

The students have been charged with child exploitation and possession of child pornography, both felonies. They were referred to the county's juvenile probation department, which will determine whether authorities pursue or drop the charges, Gensel said. If convicted, the students could be required to register as sex offenders, he said.

Yeah but somethings do need to be covered up things of national security etc. But all the public ones are utter crap. The word is not going to fall off its axis if we know about john terry etc. I dare say the poin is that you dont know what theyare covering up though lol.

exactly that. It's not the information itself that's important per se but the fact that they're denying the press the ability to report it by abusing a draconian legal device that's being used way out of the context it was intended for.

I woudnt say its draconian but it is being abused. Maybe i just see things different as its not that unusual to me having signed the national secrets act etc.

 

nothing wrong with the national secrets act etc. Some things quite naturally need to be kept out of the press to serve a greater good or to adhere to a social morality. The difference with super injunctions, and why they're so completely mental, is that the way they're being used is way out of line with any legal or moral precedent are are just being used by canny legal teams to smother the press.

South Australian Government gags internet debate.

SOUTH Australia has become one of the few states in the world to censor the internet.

 

The new law, which came into force on January 6, requires anyone making an online comment about next month's state election to publish their real name and postcode.

 

The law will affect anyone posting a comment on an election story on The Advertiser's AdelaideNow website, as well as other Australian news sites.

 

It could also apply to election comment made on social networking sites such as Facebook and Twitter.

 

The law, which was pushed through last year as part of a raft of amendments to the Electoral Act and supported by the Liberal Party, also requires media organisations to keep a person's real name and full address on file for six months, and they face fines of $5000 if they do not hand over this information to the Electoral Commissioner.

 

 

Poor Austrians have no free speech. :hmm:
