Take Two Turns Tables on Thompson

 

 

US, March 16, 2007 - Take Two and Jack Thompson have a long history together. But usually it's Thompson attacking the publisher, not the other way around. The Florida attorney has declared his intentions to try and block the sale of Take Two's upcoming games Grand Theft Auto IV and Manhunt 2. The company has apparently decided it's not going to take Thompson's attacks lying down, and has filed a preemptive motion with the U.S. District Court for the Southern District of Florida to silence Thompson's complaints.

 

GamePolitics has reported that Take Two filed its petition on March 13. The motion states that Take Two is "seeking declatory and injunctive relief against Defendant John B. Thompson, to enjoin him from bringing suit on behalf of the State of Florida to enjoin the sale of GTAIV or Manhunt 2 as a nuisance."

 

Take Two presents this action as necessary because "Thompson has a history of making multiple threats of legal action, whether substantiated or not, both against (Take Two) as well as the retailers who purchase the video games and offer them for sale to the public. Thompson has made such threats again in connection with Manhunt 2 and GTAIV…"

 

The publisher also points out that numerous courts have found complaints similar to Thompson's unconstitutional, and claims his newest intentions are likely to be dismissed on the same grounds.

 

 

 

Lol poor poor stupid man, I suppose the saying "What goes around comes around" fits in well here, silly man.

 

I can get what he is getting at with the whole "kids pick up bad ideas from violent games" because it is true for some kids (not for me but hey) but that isn't the fault of the developers, it can partly be the fault of the retailers if they sell kids the games, but I reckon it is partly the fault of the parents for being stupid enough to buy their kids violent games, but also it's to do with the kids psyche I think some have the ability to determine what is reality and what isn't, and some don't have that ability, what makes some kids like that I don't know but I don't think it has anything to do with the developers.

 

I think as long as you can determine what is applicable to reality and what isn't violent gaming is fine, and even sometimes healthy. I can definitely see why Take Two have finally asked for somebody to shut this guy up, it's as bad as anybody gossiping, unless you have proper hard facts shut up and stop ruining peoples reputations.

It was about time that TakeTwo started a lawsuit - Jack Thompson has been playing it smart - giving the company a bad name, even though they didn't lose any trials. For Jack, all atention was positive to his cause. I hope he is silenced for once and for all on the games industry - and what TakeTwo says is right - his statements go straight against the first amendment, freedom to assemble. I hope they win and Jack Thompson is shutted up.

Jack Thompson responds to the Take Two lawsuit

Yesterday we reported that Take Two launched a preemptive lawsuit against Jack Thompson aimed at preventing him from pursuing claims in court later this year when both Manhunt 2 and Grand Theft Auto IV debut.

 

Thompson contacted Ars Technica with a response to the suit, and because we wouldn't want to be unfair, here it is in its entirety:

Dear Gamers and Gamer Publications on the Internet and Elsewhere:

 

I have been praying, literally, that Take-Two and its lawyers would do something so stupid, so arrogant, so dumb, even dumber than what they have to date done, that such a misstep would enable me to destroy Take-Two. With the filing of this SLAPP lawsuit last week, my prayers are finally answered.

 

This lawsuit, filed in US District Court for the Southern District of Florida, is, without a doubt, the single dumbest thing I have ever seen any lawyers do in my thirty years of practicing law--while in continuous good standing to do so with The Florida Bar, I might add, the shock radio and video game industry's efforts notwithstanding.

 

I encourage folks to read Psalm 35, a Psalm of David, which is brilliant in its entirety (since God Himself wrote it), but for those who don't own a Bible or who think their hands will catch on fire if they touch one, here is the salient portion that applies to this lawsuit:

 

7 For without cause have they hid for me their net in a pit,

which without cause they have digged for my soul.

 

8 Let destruction come upon him at unawares;

and let his net that he hath hid catch himself:

into that very destruction let him fall.

 

9 And my soul shall be joyful in the LORD:

it shall rejoice in his salvation.

 

The pit Take-Two has dug for itself will be patently clear next week when I strike back. Oh, and by the way, the entire Take-Two management and board will be gone on March 23, so this pit-digging comes at a very bad time indeed.

Ooooo how that makes me angry, I hope you guys realise he does not speak for all Christians, I myself am a Christian, fully practising, not somebody who just claims to be, and I certainly don't agree with this mans actions, I use the term man loosely here, I wouldn't mind if he had responded and actually seemed sane but it makes me angry he used the Lords words in his wrong battle. I don't recall anywhere in the Bible Jesus saying anything that could even be loosely translated as "Playing violent games is evil", by even suggesting this this snake has breached the whole belief that Christianity is not a set of rules, that we still have freedom. How rude and inconsiderate. I play violent games, not because I feel like I need to kill humans or human like people but because they quite often have good story lines and the people aren't real so it doesn't matter, if any of you have seen my quick comments on manhunt 2 you'll know I even find it funny because the story line is so absurd but that is partly what makes it a good game.

 

Lol anyway in summary we aren't all horrible people trying to ruin a good gaming experience.

 

Oh and I eagerly await March 23rd to see if this man has been silenced or to see if Take Two have actually been taken down. Hopefully the man will be silenced.

He hasn't been following his own career very well then :grin:

 

Maybe all gamers should put a couple of quid into a pot and raise a class action against him, for wasting the time of the legal system, which might better dedicated to, you know, putting criminals in jail... :p

I think Jack Thompson is a secret conspiracy theory, employed by Take Two in a radical new form of publishing, and soon we will see a similar kind of lawyer called Tack Johnson suing Sony lots for ridiculous things.
