Nintenchris Posted November 17, 2005 Posted November 17, 2005 Right i have looked all over the internet and cant find the answer to the question im about to ask.. so i thought one of you guys would know! Right then, my mum works at a cleaning job in the evening for a few hours a night at some office. At christmas this perticular office is shut down for just over a week instead of the normal few days like most over places. Now her employer says to her "you wont be getting paid while the office is shut.." but if you want some work in another office you can go there while hers is shut! Now my mums employer will be getting the money for the job she doe's because the office she works at has to pay them as its not my mums employers fault that they are shut down for over a week. So where does she stand... should her employer pay her for not being there, even tho she would be able to work over the time the office will be closed or is her employer right to say that shes not getting paid for the time its closed?
mike-zim Posted November 17, 2005 Posted November 17, 2005 it depends. is she salaried or on a wage? if she is on a wage is she gaurenteed hours?
Nintenchris Posted November 17, 2005 Author Posted November 17, 2005 On a wage and she does 2 hours every night permently
mike-zim Posted November 17, 2005 Posted November 17, 2005 Well if she is on a wage and the contract she signed gauranteed the hours. then they have to pay her. but if it does not state in the contract that they are gauranteed then she does not have a leg to stand on.
