After nearly 2 years on the market, companies should not be able to progress claims. If a company holds a patent, it should take account of this asset and monitor it- if someone moved into your home, you wouldn't wait 2 years to file an eviction notice. Nonsense. But the sad thing is a patent judge will no doubt agree and fine Nintendo vast amounts of cash.
